The CopyMight Coalition is Fighting Against AI Copyright Infringement

Ever since the first LLMs came onto the scene, bloggers have rightly been worried about how the new AI world uses our content.

Are they giving us a backlink, or are they just stealing our words and intellectual property to cut us out? There have been a million questions about where the industry is going, and even more about how we as creators can fight back.

We were recently put in touch with the team at The CopyMight Coalition via a few trusted blogging colleagues, and are happy to report that we finally have one such opportunity to put copyright infringers in their place.

The CopyMight Coalition is gearing up for a massive lawsuit against AI companies that are engaging in copyright infringement against web publishers, and we wanted to share more about how you can sign up to be a part of the process and possibly receive damages if a lawsuit moves forward.

The CopyMight Coalition is Protecting Creators' Copyrights from AI

The CopyMight Coalition has two main goals when it comes to protecting creators' copyrights from AI:

  1. They are going to litigate for damages when LLMs engage in copyright infringement against our work.
  2. They are working towards building a licensing model where LLMs can pay creators to train off our content for payment.

We think the future for point number two is probably way off, but the first one about litigating for damages is what piqued our interest here (just note that by signing up, you're giving them authority to do both on your behalf).

The process for litigation at The CopyMight Coalition is simple. After registering, they pull published articles less than 90 days old, plus any new articles published between onboarding and a likely future lawsuit, into their system for tracking. We can't say how their proprietary system functions from there, but they're monitoring every submitted article for LLM copyright infringements once you opt in.

If they get a hit, they will register your article with the US Copyright Office on your behalf (which is why content must be less than 90 days old), notify you, and add it to the log for a future lawsuit against whichever particular company has infringed.

Will you get a hit? Maybe, maybe not. But given that every hit can be eligible for a payment as part of a lawsuit, we hope there will be a lot of potential infringements for creators to be compensated over- but we really can't say. Will a payout be quick? Also, probably not. This is going to be a fairly long process of amassing infringements, building a case, and going to court- and that is all before any settlement could potentially happen.

But they will be doing all this work behind the scenes in hopes that lawsuits can one day move forward in 2026 or beyond- fighting on behalf of creators whose IP is being infringed day in, day out by LLMs. Then, as a result of further lawsuits, we may move to a future where LLMs engage in fair pay-per-use modeling, of which they will also be ready to license our content further via collective bargaining.

  • Important: This opportunity is open for everyone, from any country. We're told that you do not have to be American to participate, even though infringed content will be registered with the US Copyright Office for the purposes of a lawsuit. The CopyMight Coalition will pay to register any infringed content on your behalf at no cost to you.
  • The payment split for creators is a pro-rata share of 51% of net proceeds of any lawsuit, and 70% share for licensing. We'll talk more about lawsuit damages in a moment.

Why The CopyMight Coalition Has a Chance

So, why does The CopyMight Coalition stand out as a company that is likely to secure damages? Well, for one, we're told that their head legal counsel, Sussman Godfrey, was behind the recent copyright infringement lawsuit against Anthropic. So they have first-hand experience in navigating copyright infringements in the AI era.

Throw on the company's in-house system for tracking infringements, which will work behind the scenes without bloggers having to do anything beyond opting in, and we could see how this one has a pathway to success.

Furthermore, this is also the first such process we've heard about where bloggers can fight back. So it does feel like a bit of “this is a new and somewhat untested process,” and we will be the first to caution that this is also a major what-if. We, personally, would just like to be on the side that puts LLMs in their place and fights for an equitable future for all creators, and that's a start.

So while we can't say that every creator who signs up will get a hit, let alone damages, we can simply say we just see where the wind is blowing, and we will throw our hand in for protecting our copyrights.

What Kind of Damages Are Possible?

Damages for Lawsuit

When copyright infringement occurs on registered content, damages can be up to $150,000 per instance as per US law, and that's for each article infringed upon, not sitewide. However, with massive lawsuits often come negotiated settlements, and past lawsuits have resulted in payouts of thousands of dollars per instance as a starting precedent. The Anthropic lawsuit mentioned above had an average lawsuit payment of about $3,000 per infringement which, even accounting for legal fees, is no small amount- every published article that is infringed upon could be eligible.

We don't expect to make that kind of money licensing content in the future!

This, of course, is a big question and any amount of damages won't be known until when, and we will also go as far as saying if a lawsuit is victorious and damages become finalized many months or even years in the future.

To put it bluntly, we really don't know what the future holds here, but we really do want to receive damages if our work is being infringed upon all the same.

It is worth noting that by signing up with The CopyMight Coalition, you will agree that they will receive a split of any damages for their work on the lawsuit as well. So while we cannot say what, if any, final damage amount will be, we are interested in this one because it is a way to protect our content and receive some form of payout for copyright infringement- all for letting someone else do the heavy lifting while we continue to do what we do best- create content.

What Does an AI Future Look Like?

Licensing

Many experts and advocates in the AI landscape are currently lobbying for a pay-per-use model where creators get paid a nominal amount every time AI references their content. This, of course, is a long way off, and AI models seemingly do whatever they please with limited repercussions.

Many believe that AI companies are breaking the law and dealing with the payouts of lawsuits because a few billion dollars in damages is nothing compared to cornering the information market and beating out other companies along the way. That is what will likely make the winning company(s) trillions in profit, and billions in fines is a small price to pay to get there. (Note: We don't agree with this practice of course, but it does seem like what is going on.)

That said, there will likely come a time when the AI landscape is no longer the wild wild west. There will be a point in the not-so-distant future where AI companies play by (mostly) established rules and ethics, and the era of mass lawsuits over AI content will become few and far between.

But until then, it is up to us, as a community, to protect our own interests and join lawsuits when we have been infringed upon, and The CopyMight Coalition is advocating on behalf of creators for financial compensation.

Is your content being infringed upon? We've said it once, we've said it twice, we'll say it again- we can't say for certain. Will you get a payout? There is a long string of events that have to happen before we can make any claims here. Can we guarantee anything here? Not really. But this one feels like a step in the right direction because you can't know if you're being infringed upon unless you check, and you can't receive damages unless you join a lawsuit- this is one such opportunity, and it is completely free to sign on.
